1. Agreement to Terms

By accessing or using Pulse's software platform and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users, including educational institutions, administrators, teachers, and other users of the Service.

2. Description of Service

Pulse provides a software platform that helps educational institutions automate attendance tracking, streamline communication workflows, and generate reports. The Service includes:

  • Dashboard and analytics tools
  • Workflow automation and alerts
  • Integration with existing school systems (SIS, LMS, etc.)
  • Mobile and web applications
  • Customer support and training

3. Eligibility

The Service is intended for use by educational institutions and their authorized personnel. By using the Service, you represent and warrant that:

  • You are authorized to act on behalf of an educational institution
  • You are at least 18 years old
  • You have the authority to bind your institution to these Terms

4. Account Registration

To access the Service, you must register an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Ensure all users comply with these Terms

Pulse reserves the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Reverse engineer or decompile the Service
  • Sell, resell, or sublicense the Service
  • Use the Service to transmit harmful or malicious code
  • Violate any applicable laws or regulations

6. Data Ownership

Educational institutions retain all ownership rights to data they input into the Service. Pulse does not claim ownership of your data. We use your data solely to provide the Service as described in our Privacy Policy.

7. Intellectual Property

Pulse retains all intellectual property rights in the Service, including software, designs, trademarks, and documentation. You receive a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Fees and Payment

Access to the Service may require payment of fees. Fee structures will be provided separately in a subscription agreement or order form. Payment terms include:

  • Fees are billed in advance
  • Fees are non-refundable except as required by law
  • Late payments may result in service suspension
  • Fees are subject to change with notice

9. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary information disclosed during the use of the Service. This includes student data, employee information, and business processes.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, PULSE CONNECT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSE CONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO PULSE CONNECT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Pulse from any claims, liabilities, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Term and Termination

These Terms remain in effect as long as you use the Service. Either party may terminate the service agreement according to the terms of the subscription agreement. Upon termination:

  • Your right to use the Service will cease
  • You may export your data within a reasonable timeframe
  • Outstanding fees remain due

14. Modifications to Service

Pulse reserves the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes when possible.

15. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the federal or state courts located in Dallas County, Texas.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
